Tennessee Judge Issues Temporary Injunction Halting Implementation of Hemp Product Ban

A judge in Nashville, Tennessee has issued a temporary injunction that halts the implementation of new hemp product testing rules in the state. These rules would have resulted in a ban on highly demanded hemp products that became legal when the state established its hemp program back in 2019. The ban was slated to take effect on Boxing Day. However, the ruling made by I’Ashea Myles on Monday put the rules on ice, at least up to February 18 when the judge will have had ample time to study the testing regulations and then make a decision on the two…

Tennessee Judge Hears Case Challenging New Hemp Rules

Earlier this week, a judge in Nashville revealed that she’d announce her ruling on an application made by the state’s hemp industry to block state regulations from coming into effect by Christmas Eve. Chancellor I’Ashea Myles of Davidson County, who presided over an almost 3-hour hearing, told attorneys that her mind was made up on the matter. The new regulations, which are set to kick in on December 26th, would criminalize the sale of different hemp products, a move that would negatively impact hemp retailers, distributors and manufacturers in the state. This comes barely 5 years after hemp was federally…

Illinois Governor Supports Bill Seeking to Regulate Hemp Products

Last week, Illinois governor JB Pritzker announced that he supported the creation of new regulations to reel in the state’s burgeoning hemp industry. Speaking at a news conference in Chicago, the governor explained that in the time since both federal and state governments legalized the production of this crop, a new industry in which chemicals are extracted from hemp plants to produce intoxicating and possibly dangerous products that were unregulated had emerged. Pritzker added that the intoxicating hemp industry was selling products derived from hemp like delta-8 to minors through the use of deceptive ad tactics. He noted that these…

Hemp Shops in Florida Poised to Benefit from Failure to Legalize Recreational Marijuana

Small hemp retailers in Florida may benefit from the ongoing ban on recreational cannabis, following Amendment 3’s failure at the ballot. At the moment, over 9500 shops in the state are licensed to sell cannabis-like products derived from the hemp crop. Of this number, nearly 1500 are found in Tampa Bay. This includes Chillum Mushroom & Hemp Dispensary, The Hemp Spot and St. Pete 420. A recent investigation found that some of these products meet the definition of cannabis but remain on the shelves regardless. The investigation also discovered that other products also contained harmful levels of pesticides and mold.…

Calls Intensify for the Creation of International Hemp Standards

The global hemp sector continues to call for the creation of universal, transparent, and science-based regulations as the discussion on cannabinoid limits imposed on hemp-derived feed rage. This discussion was tabled a couple of months ago when the Association of American Feed Controls and the Center for Veterinary Medicine approved hemp seed meal for use as feed for laying hens. Hemp seed meal comes from mechanically processed Cannabis sativa L. Following its approval, it can be used as a fat source and protein for laying hens in America, with an inclusion rate of not more than 20%. While this is…

Hemp Businesses in New York Find Themselves in the Crosshairs of Law Enforcement

This past summer, hemp businesses in the state of New York sued the Office of Cannabis Management following confiscation of product worth thousands of dollars by law enforcement. This comes after roughly $15 million allocated to this office was used to expand the enforcement arm centered on taking down thousands of illegal cannabis stores operating in the state. Local police were also given the authority to padlock these stores shut. Tyler Lehmann, CEO and President of Breckenridge Hemp, revealed that sheriffs in New York City confiscated product valued at more than $130,000 from his legally licensed hemp store in Manhattan…

Illinois Delays the Implementation of its New Hemp Rules as Pushback Mounts

The Illinois Department of Agriculture and a legislative committee in the state agreed to delay the finalization of new rules governing the production of hemp by 45 days. Industrial hemp became federally legal with the passage of the 2018 Farm Bill, permitting large-scale production of the crop. In 2019, the Illinois General Assembly approved the Industrial Hemp Act, allowing the state’s agriculture department to regulate the industry. Since then, the department has focused on promulgating regulations consistent with both federal and state hemp laws. In 2021, the federal Department of Agriculture published final regulations for producing hemp, which contained substantial…
