DEA Asserts That THCA Doesn’t Conform to Legal Hemp Definition

In the 2018 Farm Bill, hemp is defined as a marijuana product that contains under 0.3% delta-9 THC. Recently, a top official at the U.S. Drug Enforcement Agency (“DEA”) clarified in a new letter that this limit included delta-9 THC as well as THCA, a cannabinoid which changes into delta-9 THC when heated. In the letter, Terrence Boss stated that Congress had directed that the concentration of delta-9 THC be tested using techniques such as post-decarboxylation. New Iowa Law Bans Intoxicating Hemp Derivatives, Imposes Restrictions on CBD

Governor Kim Reynolds of Iowa recently signed a measure that bans synthetically produced delta-8 THC and other laboratory-made intoxicating compounds. Other popular intoxicating hemp compounds that are banned include THCP, THC-O-acetate, delta-10 THC and THCA. Data from national poison control centers revealed that between 2021 and 2023, almost 8,000 individuals reported terrible effects after consuming products that contained intoxicating hemp compounds. Marijuana companies, state regulators, hemp businesses, prohibitionists and Congressional lawmakers are all scrambling to see their priorities addressed in the upcoming farm bill.
