New Iowa Law Bans Intoxicating Hemp Derivatives, Imposes Restrictions on CBD

Governor Kim Reynolds of Iowa recently signed a measure that bans synthetically produced delta-8 THC and other laboratory-made intoxicating compounds. Other popular intoxicating hemp compounds that are banned include THCP, THC-O-acetate, delta-10 THC and THCA. Data from national poison control centers revealed that between 2021 and 2023, almost 8,000 individuals reported terrible effects after consuming products that contained intoxicating hemp compounds. The bill, Iowa House File 2605, also limits the use and sale of naturally derived CBD to individuals aged 21 years of age and older. CBD (cannabidiol) is one of the two primary compounds found in the cannabis plant,…

Republican House Leaders Want Farm Bill to Reduce Regulatory Barriers Faced by Hemp Growers

Republican leaders in the house have presented a draft version of a large-scale agriculture bill that could decrease regulatory barriers for some hemp farmers and curtail a ban on industry participation by individuals with previous drug felony convictions. The bill is notably silent on provisions that would ban cannabinoid products derived from hemp. The House Agriculture Committee released the draft farm bill last week, building upon the federal legalization of hemp in several ways. The current draft revises hemp’s definition, establishing different categories for industrial hemp producers who grow the crop for grain, oil, fiber and seed not intended for…

Opinions Divided on How Upcoming Farm Bill Should Regard Intoxicating Hemp Derivatives

Marijuana companies, state regulators, hemp businesses, prohibitionists and Congressional lawmakers are all scrambling to see their priorities addressed in the upcoming farm bill. While there are some points of agreement by various groups, the points on which they differ are generating measurable tension. For example, hemp industry actors are disturbed that some marijuana companies have allied with prohibitionists to see some hemp derivatives outlawed. Edward Conklin, executive director of the United States Cannabis Council (“USCC”), sent a letter to select Congressional leaders in April. He indicated that it was complicated to make policy changes regarding hemp and requested that urgent…

Illinois Lawmakers Want More Oversight of Hemp Industry

Lawmakers in Illinois are calling for increased oversight over the state’s largely unregulated hemp derivatives market. This market ballooned in the years after the 2018 Farm Bill legalized industrial hemp and hemp extracts across the United States under state and tribal programs. In the wake of this legislation, many businesses took advantage of legal loopholes to process and sell hemp derivatives such as cannabidiol (“CBD”), and delta-8 THC. While these derivatives technically aren't illegal under federal law, there are few if any federal or state regulations governing their production and sale. As a result, Illinois and other states with hemp…

USDA Data Shows Hemp Acreage Shrinking in Midwest

A recent report authored by the U.S. Department of Agriculture indicates that the quantity of hemp being cultivated by farmers in the Great Plains and Midwest region of the country has reduced in comparison to what it was two years prior. However, one research experts sees this reduction as something good. David Lakeman, head of the department of agriculture in Illinois, says the explosive interest in growing hemp after the enactment of the 2018 Farm Bill through which hemp was legalized resulted in the value chain for the plant being overwhelmed. He notes that there was a need to establish…
