Hemp Advocates Consider Suing California Governor for Banning Hemp Intoxicants

Hemp advocates in the state of California may sue the governor over the recently proposed emergency rules because they may negatively impact vulnerable individuals. During a press conference held earlier this month, Governor Gavin Newsom announced that he would be clamping down on intoxicating hemp products that were often marketed to minors.

The governor explained that because drug peddlers are targeting children with unregulated and dangerous hemp products containing THC, it was important to increase enforcement to prevent minors from accessing these products, while also closing loopholes. Newsom proposed these regulations after AB 2223, which targeted hemp, failed to get approved in the Senate.

One Hemp, a coalition of companies that advocate for U.S. Food and Drug Administration (FDA) regulation of CBD products derived from hemp, argues that a lawsuit may be the solution if the regulations proposed by Gov. Newsom take effect. The regulations would limit access to CBD wellness products, which may affect those with disabilities in the state.

Coalition for Access Now director, Paige Fiji, stated that these policies would wipe out hemp as a category instead of dealing with Delta 8 as an entity. Fiji added that there was no place for CBD products to be bought under these regulations, noting that it was possible to eliminate Delta 8 from the state while preserving CBD wellness products.

Advocates such as One Hemp and Fiji believe the governor is acting ultra vires. When asked to respond to this claim, a spokesperson with the governor’s office noted that official officials don’t comment on false claims.

Advocates note that while they support these rules, they are too broad and will affect others in the industry who rely on hemp products. For instance, Jana Adams reveals that CBD changed the life of her daughter, Brooke, who began having violent epileptic seizures at the age of three months old. Adams noted that since her daughter had started using CBD, she hadn’t experienced a seizure in over three months. The family adds that while the proposed rules will do good, they could also have grave consequences if they limited or cut off access to CBD for families that need them.

Veterans may also be impacted by these rules, given that there are five million individuals who use CBD in the state. In addition, the regulations may increase the cost of these drugs, which aren’t covered by insurance.

Newsom signaled that the rules would take effect as soon as the Office of Administrative Law approved them. Public comment on the proposed rules ended on Sept. 18, 2024.

An ideal path for the hemp industry and companies that make CBD products, such as Software Effective Solutions Corp.
