On Wednesday, the Brazilian pharmaceutical regulator, Anvisa, approved the roll-out of medicinal marijuana-based products. However, in a separate vote, Anvisa vetoed a proposal seeking to legalize the cultivation of domestic medical marijuana. But, one company was authorized to cultivate industrial hemp by a judge.
According to Sechat.com, the Federal District Brasilia judge made a ruling that goes into the history books by authorizing the cultivation and importation of industrial hemp seeds by Terra Viva Company. The hemp seeds’ THC concentration must be below 0.3%. Terra Viva could sell seeds, leaves, and fiber hours after the announcement by Anvisa.
On Tuesday, the Federal Court of the Federal District of Brasilia authorized Schoenmaker Humako Agri-Floriculture, which is a branch of Terra Viva group, to import and cultivate industrial hemp seeds with a THC concentration of less than 0.3%. The authorization comes a few hours after the Brazilian Regulatory Body filed a motion to legalize the cultivation of weed for medicinal and research purposes in Brazil.
Judge Renato Coelho Borelli of the 9th Federal Civil Court of SJDF said that the company could commercially trade in fiber, seeds, and leaves. The inspection of the products would be done by Anvisa and the Ministry of Agriculture.
The judge also decided that the Ministry of Agriculture should include industrial hemp or hemp on the National Cultivar Register list RNC, created by Law no. 10.711/2003, and regulated by Decree no. 5153/2004.
Terra Viva submitted a request seeking approval to import and grow hemp seeds. The company sought authorization to trade in the plant’s fiber, leaf, and grain in their natural form or after processing them for oil extraction, which could be exported for the production of drugs, herbal medicines, and food supplements.
Judge Borelli further said that it is impossible for hemp to be confused with weed as it does not give a high effect. Hemp is exclusively intended for industrial and medical use, and several countries have been growing hemp for fiber production.
Terra Viva also argued that hemp could be used to produce products such as clothing, cooking oil, beauty products, detergent, shoes, paper paint, and insulators.
On Tuesday, Anvisa approved rules allowing the registration of medical cannabis products in Brazil. The approved measure will enable companies to acquire endorsements for the production of therapeutic products in the country.
The magistrate also urged the companies to note that the authorization is for industrial hemp and not marijuana. Judge Borelli also pointed out that the approval is for importation and cultivation of hemp seed and sale of their products.
