Following the legalization of hemp with the passage of the 2018 Farm Bill, states across the country have seen an increase in the sale of products with intoxicating hemp cannabinoids. The bill’s passage saw a loophole that allowed the sale and manufacture of products with THC derived from hemp be created.
These products, which are accessible by everyone including minors, aren’t regulated by any federal law. In an attempt to curb their proliferation, various jurisdictions have taken to implementing regulations governing their use, manufacture and sale, particularly to underage individuals.
Recently, a hemp organization based in Kentucky revealed that it had developed a certification program for these hemp products.
Last week, the U.S. Hemp Authority rolled out its Adult Use Hemp Product Certification Program, designed for sellers and manufacturers of products with delta-8 THC and other cannabinoids derived from hemp. The body is charged with issuing third-party certification for CBD and hemp products.
In its news release, President Chris Fontes explained that their intention was ensuring that the hemp industry regulated itself to increase stability and safety. He added that this would demonstrate to regulators and legislators that the industry was comprised mainly of good actors focused on providing quality goods to consumers.
For a product to qualify for certification issued by the Hemp Authority, it must:
- Utilize child-resistant packaging
- Comply with ASTM product labeling
- Be restricted to individuals aged 21 and above
- Be free of new cannabinoids like delta-10 THC, THCP, HHC, and THC-O
- Contain only delta-9 or delta-8 THC
- Follow the FDA’s Current Good Manufacturing Practice
- Observe purity standards
- Undergo potency and purity tests at a lab accredited by the ISO
Other notable actions taken to protect cannabis programs in the country from intoxicating cannabinoids include California’s recent passage of emergency regulations. The Golden State recently approved rules that banned hemp products with any THC levels sold outside of its legal and regulated cannabis market.
The rules were proposed by the state’s public health department and were enacted following approval by the Office of Administrative Law. They were developed in response to growing health incidents associated with these products, which included their being marketed to minors.
It remains to be seen whether intoxicating hemp products will survive the passage of the upcoming Farm Bill, as more and more parties call for legislators to plug the loophole.
