Delta 8, Medical Cannabis Industries in Texas to Face Off During Next Legislative Session

Texas’ Compassionate Use Program may be facing its worst crisis since its establishment in 2015. The program imposes strict rules on individuals with certain medical conditions who are eligible to use THC, what products can be sold to individuals, and where these products can be stored.

These regulations have limited the impact of the program as well as its growth, while allowing unregulated hemp products like delta-9 and delta-8 THC to record increases in demand because they’re easy to access. This has resulted in competition between the hemp industry and medical marijuana market in the state of Texas.

Other states like California and Colorado, where both recreational and medical cannabis are legal, have already implemented tighter regulations on hemp products in an effort to force more safety and health accountability on the burgeoning industry and control access.

In the case of Texas, Senator Charles Perry is also working towards banning the consumable hemp market. Perry and other legislators are especially interested in the regulation of consumable THC products that can come in beverage form. This is because it makes it harder for law enforcement, teachers, parents and others to differentiate between beverages infused with THC and regular beverages.

Lieutenant Governor Dan Patrick has already given senators legislative directives for the upcoming session, with a focus on banning delta-8 products.

He suggested to legislators that they examine intoxicating hemp product sales in the state, give recommendations on how the sale of these products can be regulated, and propose a measure to bar retailers who market the products to minors.

The state’s Health Services department has also filed a case before the Texas Supreme Court, seeking to categorize delta-8 THC as an illegal substance. The hemp industry argued in court that the compound’s high was minimal, claiming that banning their products would greatly harm the industry and Texas’ economy.

A ban would also impact farmers that cultivate hemp, with data from the Texas Hemp Business Council showing that these products have an annual economic impact of $8 billion.

This isn’t the first time the department has tried banning delta-8 by categorizing it as an illicit substance either. The FDA has also given warnings about the negative impacts on health that unregulated hemp products may have, including anxiety, vomiting, hallucinations, and loss of consciousness.

It is important to note that delta-8 is still legal to sell and buy while the case is pending. Currently, it is legal to use and purchase most smokable hemp products like vape cartridges and flower with delta-8, THCA and CBD.
